This privacy policy (this “Privacy Policy”) describes the practices of Lunatix website (managed by the Creator) and the associated e-commerce platform operated by our Merchant of Record, Fourthwall (which together constitute the “Services”), with respect to the Personal Information collected from or about you when you use the Services.

  • Purchase/Registration Information: When you make a purchase, your name, email address, shipping address, and phone number are collected by our Merchant of Record, Fourthwall, to process and fulfill your order. This information is shared strictly for account management, marketing (if opted in), and customer support purposes.
  • Financial Information: When you make a purchase using the Services, all payments and transactions are processed directly by our Merchant of Record, Fourthwall. We do not collect, store, or process your payment card information. Your financial data is collected and managed securely by Fourthwall in accordance with their own Privacy Policy.
  • Transaction Information: When you make a purchase using the Services, information about the transaction is collected, such as the purchase amount, product purchased, and date of purchase.
  • Communications: When you communicate with the support team, your name, contact information, and the content of any messages you send are collected to assist you.

You are not required to provide any information, but some features of the Services may not be accessible to you unless you provide certain information.

  • Vendors and other Service Providers: Person Information may be disclosed to vendors and independent contractors who perform services, including Fourthwall, Inc., a Delaware corporation, the vendor that assists in providing the website and ecommerce solutions. Vendors and independent contractors provide such services as: data storage, analytics, billing, marketing, product content and features, customer service, data storage, security, fraud prevention, and legal services.
  • Safety and Protection: Person Information may be disclosed to appropriate third parties if it is believed in good faith that doing so is necessary or appropriate to protect or defend rights, safety, or property, including to defend or enforce this Privacy Policy or any other contractual arrangement.
  • Legal Requirements: Person Information may be disclosed to government authorities or other third parties if it is believed in good faith that doing so is necessary or appropriate to comply with any law enforcement, legal, or regulatory process, such as to respond to a warrant, subpoena, court order, or other applicable laws and regulations.

Online Analytics and Tailored Advertising

Online Analytics:

The Services may use third-party web analytics services, such as those of Google Analytics. These vendors use the sort of technology described in the “Personal information automatically provided when you use the Services” section above to help analyze how you use the Services, including by noting the third-party website from which you arrive. The information collected by this technology will be disclosed to or collected directly by these vendors, who use the information to evaluate your use of the Services. The Services also use Google Analytics for certain purposes related to advertising, as described in the following section. The operator of Lunatix website is considered the “data controller” for non-transactional personal data handled under this Privacy Policy. Please note that for all transactional, payment, and order fulfillment data, the Merchant of Record, Fourthwall, acts as an independent or joint data controller. The laws of some jurisdictions such as the laws of the European Economic Area and the United Kingdom require data controllers to tell you about the legal grounds they rely on for using or disclosing of your Personal Information. To the extent those laws apply, the legal grounds are as follows:

  • Contractual Necessity: Personal Information may be used or disclosed to honor contractual commitments to you. 
  • With Your Consent: Where required by law, and in some other cases, Personal Information is used or disclosed on the basis of your consent. You may withdraw any consent you previously provided regarding the processing of your Personal Information, at any time and free of charge. he CCPA sets forth certain obligations for businesses that “sell” or “share” personal information. Personal information may be disclosed to third parties for purposes of analytics and advertising. Under the CCPA, disclosing personal information to these third parties may be considered a “sale” of personal information or the “sharing” of personal information for purposes of “cross-context behavioral advertising.”

Do Not Track

Browser-initiated Do Not Track signals are not responded to, as the Internet industry is currently still working on Do Not Track standards. Please note that Do Not Track is a different privacy mechanism than the Global Privacy Control browser choice referenced above.

Shine the Light

Under California’s “Shine the Light” law, California residents may request certain information regarding the disclosure of information to third parties for their direct marketing purposes. Information is not disclosed to third parties for their direct marketing purposes.

Children’s Privacy

Personal Information of children under 13 years of age is not knowingly collected, maintained, or used, and no part of the Services are directed to children. The length of time depends on the purposes for which it was collected and your choices, after which time it may be deleted and/or aggregated. Personal Information may also be retained and used as necessary to comply with legal obligations, resolve disputes, and enforce agreements.

Consent to Transfer
